Annexed property owners contest collection of 2012 taxes by city

NEWPORT-Four people with properties annexed by the City of Newport filed a legal Complaint against the city saying they should not have been liable for 2012 city property taxes because their appeals to the annexation continued into 2012.

Carol Ann Williford Grooms, Dennis Edmonds, and Donnie and Kathy Miller, plaintiffs, filed the lawsuit against the City of Newport for "unlawfully assessing property taxes against the Plaintiffs' (properties) for the tax year 2012."

The lawsuit was filed in Cocke County Circuit Court on June 5.

The plaintiffs' attorney, David S. Wigler, of the Law Office of Herbert S. Moncier in Knoxville, wrote a letter dated March 21 to Charlton DeVault, Jr. and City Attorney Terry Hurst seeking the nullification of tax bills sent to the three parties in the lawsuit.

Wigler's letter, which is attached to the lawsuit, states, "If it is correct that Area 1 citizens received 2012 tax bills, that would be contrary to my understanding of the annexation and property taxation laws. Please let me know within the next two weeks whether Newport will voluntarily withdraw these tax statements, and refund any payments received by Area 1 citizens."
