NEWPORT-The path for taking roads into the county road
system may have more curves and potholes than the roads themselves.
The Cocke County Legislative Body will have a called
joint meeting with the Cocke County Planning Commission at 5 p.m. Tuesday,
March 23, in the Chancery Courtroom to discuss whether last week's approval of
roads was correct.
According to the agenda for the called meeting, the
purpose is for "reconsidering or rescinding" action taken last week,
when members voted to take in eight-tenths of Blessing Way, .64 miles of
Applewood Way, and .3 miles of Apple Grove Way as part of the county road
system.
"A couple of CLB members called County Mayor Iliff
McMahan Jr. and requested another meeting," said CLB Chairman Norman
Smith. "They are concerned that our action last week might open us up to
lawsuits from developers who have put up bonds to build roads to
specifications."
In addition, Smith said two different sources have told
him they thought last week's action on the roads should have been done by roll
call vote as opposed to a voice vote.
"Technically, because it would require us to spend
more money, I thought it should have been a roll call vote," said Smith.
"But (CLB member) Bill Williamson said to do it by voice vote, which is
what we did. I want to get the opinion of (county attorney) Fletcher
Ervin."
Last week's meeting was packed with residents who
supported taking the roads in question into the county system.
Gary Butler spoke on behalf of residents concerning
Blessing Way and attorney Patrick Stapleton spoke on behalf of residents on
Applewood Way and Apple Grove Way.
After the vote, however, Lee Willis of the Cocke County
Planning Commission said Blessing Way was rebuilt without the issue coming
before the Planning Commission and added the road does not meet specifications.
He added CLB's actions in accepting those roads will make
it hard for the Planning Commission to ask other developers to put up bonds to
make sure roads are built to specifications.
