GREENEVILLE-Ray Hawk, who was sentenced to 9 years in prison last year on federal racketeering charges, has been granted an evidentiary hearing by U.S. District Judge Ronnie Greer.
Greer granted the hearing in a ruling filed Sept. 4. The evidentiary hearing has been scheduled for Nov. 20, at 1:30 p.m. in U.S. District Court in Greeneville.
Greer stated, "The Court finds that there is a material factual dispute requiring such a hearing. However, this hearing will only be conducted in regard to grounds one and three, that is, ineffective assistance of counsel in regard to the government's initial plea offer, and ineffective assistance of counsel for failure to file a notice of appeal."
